Terms & Acceptable Use

These Terms govern your access to and use of AgentRoster (the "Service") and any data you obtain through it (the "Data"). By purchasing or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. What we provide

AgentRoster provides access to a database of business contact information for Canadian real estate professionals, compiled from publicly accessible sources (such as brokerage and franchise websites and directories). You can filter the database and purchase a list ("CSV") of the segment you select.

2. Licence to use the Data

On payment, we grant you a non-exclusive, non-transferable licence to use the purchased Data for your own legitimate business-to-business outreach. You may not:

resell, sublicense, rent, or redistribute the raw Data, in whole or in part;
publish the Data or make it publicly available;
use the Data to build a competing dataset or list-selling service; or
use the Data for any unlawful, deceptive, or harassing purpose.

3. Your compliance responsibilities (CASL & privacy)

You are solely responsible for ensuring your use of the Data complies with all applicable laws, including Canada's Anti-Spam Legislation (CASL), the Personal Information Protection and Electronic Documents Act (PIPEDA), and any provincial privacy or marketing laws.

Without limiting that responsibility, you represent and agree that you will:

only send commercial electronic messages ("CEMs") where you have valid consent or a recognized exemption (for example, messages sent to a recipient's published business email that relate to their professional role, where the conditions for implied consent are met);
clearly identify yourself and include accurate sender information in every message;
include a working, no-cost unsubscribe mechanism in every CEM and honour opt-outs promptly; and
keep your own records demonstrating your basis for contacting each recipient.

AgentRoster does not send messages on your behalf under this Service and is not responsible for how you use the Data.

4. Payment, delivery & refunds

Prices are shown in Canadian dollars and charged at checkout via Stripe. The Data is a digital product delivered immediately after payment (by download and/or email). Because the Data is delivered instantly and its value is realized on disclosure, all sales are final and non-refundable once the list has been delivered, except where a refund is required by law. If you experience a technical problem receiving your file, contact us and we will make it right.

5. Accuracy & "as is"

We take reasonable steps to verify email addresses, but contact data changes constantly. The Data is provided "as is" and "as available," without warranties of any kind, including accuracy, completeness, deliverability, or fitness for a particular purpose. We do not guarantee any specific results from using the Data.

6. Limitation of liability

To the maximum extent permitted by law, AgentRoster and its operators will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits, arising out of or relating to the Service or the Data. Our total aggregate liability for any claim is limited to the amount you paid for the order giving rise to the claim.

7. Indemnity

You agree to indemnify and hold harmless AgentRoster and its operators from any claims, damages, penalties, or costs (including reasonable legal fees) arising from your use of the Data or your breach of these Terms, including any claim relating to your messaging practices or compliance with CASL or privacy law.

8. Changes & governing law

We may update these Terms from time to time; the "last updated" date above reflects the current version. These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there.
